Michigan Catastrophic Claims Association (MCCA) Refund – FAQ

What is the MCCA?

The Michigan Catastrophic Claims Association (MCCA) is a private, non-profit association, formed by the Michigan Legislature in 1978. The MCCA’s mission is to protect the financial integrity of Michigan’s auto insurance industry by reimbursing insurance companies for catastrophic auto injury claims.

The MCCA assesses all auto insurance companies operating in Michigan to cover catastrophic medical claims resulting from motor vehicle accidents in Michigan. Each insurance company writing auto or motorcycle insurance in Michigan is required to be a member of the MCCA. The MCCA assessment is an annual per vehicle charge that is included in your auto insurance premiums. The amount of this assessment is determined by the MCCA and is collected by insurance companies, then passed on to the MCCA.

 

What is the MCCA refund?

As a result of recent no-fault reforms, the Michigan Catastrophic Claims Association (MCCA) is returning approximately $3 billion in surplus funds to Michigan policyholders. Auto-Owners is responsible for distributing this refund from the MCCA to our personal auto, commercial auto and Division I garage liability policyholders who meet the requirements set forth by the MCCA and the Michigan Department of Insurance and Financial Services (DIFS). 

 

How and when will I receive my refund?

Auto-Owners is mailing MCCA refund checks to eligible Michigan policyholders via first-class mail, using the mailing address in our policy records. We delivered refund checks for all eligible policies to the U.S. Postal Service (USPS) for distribution on March 11, 2022.  

 

What policies are eligible for a refund?

Michigan policies covering autos and motorcycles with the required liability as of 11:59 p.m. Oct. 31, 2021 are eligible to receive a refund. The MCCA instructed insurance companies to use an evaluation date of Nov. 30, 2021 to determine which policies qualify for a refund.  

Here are two example scenarios showing how the evaluation date may affect refunds:

  • You purchased a new vehicle on Oct. 31, 2021 and contacted your agent to have it added with the required liability coverage.  A policy change to add the new vehicle effective Oct. 31, 2021 was issued on Nov. 7, 2021.  This vehicle will receive a refund because the required liability was in effect as of Oct. 31, 2021 and the change was issued before the evaluation date of Nov. 30, 2021.
  • You put a seasonal vehicle in storage on Oct. 25, 2021.  A policy change to drop coverage to comprehensive only effective Oct. 25, 2021 was issued on Nov. 8, 2021.  This vehicle will not receive a refund because the required liability was not in effect as of Oct. 31, 2021 and the change was issued before the evaluation date of Nov. 30, 2021.

 

What does required liability mean?

For autos (including motorhomes and low-speed vehicles) and historic/antique autos, required liability means the vehicle was insured with bodily injury and property damage (or combined liability) and personal injury protection (PIP) coverages, regardless of the PIP Allowable Expense (Medical) limit selected.

For motorcycles, required liability means the motorcycle was insured with bodily injury and property damage (or combined liability) coverage.

For Division I garage liability policies, required liability means the location was insured with bodily injury and property damage (or combined liability) and personal injury protection (PIP) coverages, regardless of the PIP Allowable Expense (Medical) limit selected.

 

How much is the refund?

Autos and motorcycles  insured on a personal auto or commercial auto policy with the required liability in effect as of Oct. 31, 2021 will receive $400 per vehicle. 

Historic/antique autos insured on a personal auto or commercial auto policy with the required liability in effect as of Oct. 31, 2021 will receive $80 per historic/antique auto.  

Division I garage liability policies with the required liability in effect as of Oct. 31, 2021 will receive 135% of the personal injury protection written premium.    

 

Are trailers or off-road recreational vehicles eligible for a refund?

No, trailers and off-road recreational vehicles (i.e. snowmobiles, golf carts, all-terrain vehicles) are not subject to the MCCA assessment and are not eligible for a refund.

 

Are vehicles in storage with comprehensive and/or collision only coverage eligible for a refund?

No, only vehicles with the required liability in effect as of 11:59 p.m. on Oct. 31, 2021 will receive a refund. Vehicles insured for comprehensive and/or collision only do not meet the minimum required liability.  

 

Will Auto-Owners apply the refund to my billing account if I have an outstanding balance?

No, all refunds are issued in the form of a check via first-class mail. This refund is from the MCCA and does not impact coverage or premium due on any of your policies with Auto-Owners. Refund checks were issued to all eligible policyholders, regardless of the current policy status or any amount due. 

 

What if I’ve changed insurance companies since Oct. 31, 2021?

The company that provided your insurance as of Oct. 31, 2021 is responsible for issuing your MCCA refund, if you are eligible to receive one. Auto-Owners has issued refund checks for all eligible policies that were in effect with our company as of 11:59 p.m. Oct. 31, 2021, regardless of the current policy status or any amount due.

 

What should I do if I lost my refund check or did not receive a check?

Contact your Auto-Owners independent agent for assistance. Your agency’s contact information can be found on your auto proof of insurance card, your policy declarations, or your billing invoice.

If you have changed insurance companies since Oct. 31, 2021, you will need to contact the company that provided your insurance at that time. 

 

Who can I contact if I have other questions about my refund?

Contact your Auto-Owners independent agent for assistance. Your agency’s contact information can be found on your auto proof of insurance card, your policy declarations, your billing invoice, or the top of your MCCA refund.  

If you have changed insurance companies since Oct. 31, 2021, you will need to contact the company that provided your insurance at that time. 

 

Someone contacted me by phone/email asking for my banking information in order to deposit my refund. Was this call/email from Auto-Owners?

No, Auto-Owners is mailing all MCCA refund checks via first-class mail; we are not contacting policyholders to request banking information. It is important to never give out personal information including address, birthdate, Social Security number, account numbers, or passwords over the telephone or through email.
